1. Acceptance

By creating an account or using Parque (the “Service”), you confirm you are at least 18 years old and you agree to these Terms & Conditions. If you do not agree, do not use the Service.

2. What Parque is

Parque is an online marketplace that connects people who have parking space (“Hosts”) with people who want to park (“Renters”). Parque does not own, operate, or control any parking space and is not a party to the arrangement between a Host and a Renter. Hosts are solely responsible for their property and for complying with all applicable laws.

3. Overstay & towing policy — please read

When you book a spot you are paying for a specific time window. You must have your vehicle completely removed from the spot by the end of that paid window.

If your vehicle remains in the spot after your paid window ends, you are parked without permission (trespassing) on the Host's property. You acknowledge and agree that, to the fullest extent permitted by applicable law, the Host or property owner may have your vehicle booted and/or towed at your sole expense and risk, and you release Parque from any liability arising from such removal. You are responsible for any towing, storage, boot-removal, or impound fees.

Towing is regulated by state and local law. Hosts are responsible for following those laws (including any signage, licensed-tower, notice, and reporting requirements). Nothing in this policy authorizes any tow that violates applicable law.

4. Payments, fees & cancellations

Renters pay the listed total up front, which includes Parque's service fee. Cancellations are subject to the cancellation policy shown at booking, including a cancellation fee and a cutoff before the start time. Hosts receive payouts through our third-party payment processor.

5. Renter responsibilities

You agree to park only in the spot you booked, only during your paid window, only with the vehicle you registered, and to obey all posted rules and laws. You are responsible for your vehicle and its contents.

6. Host terms

As a Host, you confirm you have the legal right to rent the space, that it is safe, accurately described, and available for the entire timeframe you list, and that you will comply with all applicable laws (including towing, zoning, and HOA rules).

You will not harm the Renter's vehicle. You agree not to damage, tamper with, boot, tow, or block in a Renter's vehicle during their paid window, and to provide safe access to the spot.

Clear parking instructions are your responsibility. You must state in your listing exactly where the Renter should park. If your listing does not specify the exact spot, the Renter is not liable for parking anywhere within the described space, and any resulting misunderstanding is your responsibility as the Host — not the Renter's. (For example, if you list a “lawn” but don't say which part, a Renter cannot be blamed for parking elsewhere on the lawn.)

7. Disclaimers & limitation of liability

The Service is provided “as is.” To the fullest extent permitted by law, Parque is not liable for indirect, incidental, or consequential damages, or for the acts or omissions of Hosts or Renters, including any damage to or towing of a vehicle.

8. Indemnification

You agree to indemnify and hold Parque harmless from claims arising out of your use of the Service, your vehicle, your property, or your violation of these Terms.

9. Changes & governing law

We may update these Terms; continued use of the Service means you accept the changes. These Terms are governed by the laws of the State of [Your State], without regard to conflict-of-law rules.
